Owners of Fowl
To all persons owning fowl in the Town of Rollinsford, New Hampshire, you are hereby notified that the Selectmen for the Town of Rollinsford, NH., have approved the following ordinance pertaining to the control and custody of all domesticated fowl within the Town of Rollinsford.
Section #1: If any person having charge or custody of any chicken, duck, geese, or swan shall knowingly, recklessly, or negligently suffer or permit the same to enter upon, pass over, or remain on any improved or enclosed land of another without written permission of the owner, occupant, or his agent, and thereby injures his crops, or property, shall be guilty of a violation.
Section #2: If the person having charge or custody of the fowl, above described, is found guilty of Section #1 of this ordinance, he shall be responsible for returning the property damaged to its original condition.
Section #3: If the person having charge or custody of any chicken, duck, geese, or swan shall knowingly, recklessly, or negligently suffer or permit said fowl to make loud and unreasonable noises in a private place which can be heard in a public place or other private places, which would disturb a person of average sensibilities, is guilty of a violation.
Section #4: Prior to the invocation of any provision of this ordinance, the person having charge or custody of the fowl committing the violation, shall be notified by United States mail of the complaint. The person having charge or custody of the fowl will be given ten days to resolve the violation. If resolution is not reached after ten days, or if additional complaints are received after the ten days, then complaints will be drawn, and processed before the Dover District Court.
Section #5: Penalty-Any person found guilty under the provisions of this ordinance is guilty of a violation, and shall be fined not less that $10.00 and not more than $100.00
