Ordinance # 75-01


TOWN PARKING REGULATIONS

Section #1:

Parking any motor vehicle on any public way within the Town of Rollinsford, New Hampshire shall be prohibited between the hours of 12:00 AM Midnight and 6:00 AM from November 15th until April 1st, or until further notice. Any person in violation of this section shall be fined not more than $25.00 and shall have his or her vehicle towed away at the owner’s expense if said vehicle is or may be hindering snow removal from town streets.

Section #1A (Snow Emergencies):

The Chairman of the Board of Selectman or Chief of Police shall have the power to declare a snow emergency whereby he may order that the all night parking ban will be changed to 6:00 PM to 6:00 AM for the duration of the snow emergency only.

Section #2:

Any motor vehicle left unattended on any public way in the Town of Rollinsford, New Hampshire which is obstructing the normal flow of traffic or blocking the driver’s view in any manner shall be towed away at the owner’s expense.

Section #3:

When signs are erected, giving notice thereof, it shall be unlawful for any person having custody or control of any vehicle, to park or cause the same to be parked at any time where said signs are located.

Front Street  For 406′ beginning at the Maine State line on the northern side of roadway.

Front Street  For 382′ beginning at the Maine State line on the southern side of roadway.

Main Street  From Front Street to Church Street on the northern side of roadway.

Main Street  From Front Street to a point 60′ west of Foundry Street on the southern side of roadway.

Beccaris Drive  At a point beginning at 273′ from Main Street to a point 544′ from Main Street on both sides of roadway.

South Street  At a point beginning at the intersection of Front Street and ending at the intersection of Foundry Street on       southern side of the roadway.

Section #3A: (Temporary No Parking):

The Chief of Police shall have the authority to prohibit parking temporarily for any bonafide public purpose such as street or utility maintenance, parade, festival, or the like for a period not to exceed 72 hours by posting signs or notices to that effort. When so ordered or posted as “Temporary No Parking,” it shall be unlawful for any vehicle to park, cause to be parked, or allow to remain parked on any street or way. Any vehicle found in violation may be towed or removed to a public garage at the owner’s expense and/or fined.

Section #4: Repealed.

Section #5: When signs are erected giving notice thereof, it shall be unlawful for any person having custody or control of any vehicle to park or cause to be parked on any day upon any of the streets or parts of streets, as listed below for more than two hours.

Both sides from South Street to a point 406′ from Maine state line on western side of roadway and to a point 382′ from Maine state line on eastern side of roadway.

Section 5A: When signs are erected giving notice thereof, it shall be unlawful for any person to stand or park a vehicle along the eastern most side of Second Street between the intersections of Cross Street and South Street.

Section 5B: When signs are erected giving notice thereof, it shall be unlawful for any person to stand or park a vehicle along the northern most side of Doherty Lane.

Section 5C: When signs are erected giving notice thereof, it shall be unlawful for any person to stand or park a vehicle along Stockdale Circle (side closest to the inside of the circle or the side with the even numbered houses).

Section 6: No person shall stand on or park a vehicle in any street other than parallel with the edge of the street headed in the direction of lawful movement and with the right hand wheels of the vehicle within 12 inches of the right hand curbs, or edge of the road with left hand wheels of the vehicle with 12 inches from the left hand curb or edge of the road.

Section 7: Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or offical traffic control device, no person, except a person driving an emergency vehicle, shall:

1) Stop, stand, or park a vehicle:

A) On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
B) On a sidewalk;
C) Within an intersection;
D) On a crosswalk;
E) Between a safety zone and the adjacent curb or within 30 feet of points on the curb;
F) Alongside or opposite of any street excavation or obstruction when stopping, standing, or parking;
G) Upon any bridge or other elevated structure upon a way or within a highway tunnel;
H) On any railroad tracks;
I) At any place where official signs prohibit stopping;
J) In any parking place, whether on public or private property, specially designated for a person with a walking   disability by means of a sign as required by RSA 265:73-A stating that the space is reserved for a person with a   walking disability or displaying the international accessibility symbol, unless that person has a special plate or   placard issued or recognized pursuant to RSA 261:86 or RSA 261:88, and the person qualifies for the plate or placard     is being transported to or from the parking place. Not withstanding the provisions of title LXII or any other   provision of a law, a person who violates the provisions of this subparagraph shall be fined a minimum of $250.00;
K) On any controlled access highway;
L) In the area between roadways of a divided highway, including crossovers;
M) In or overlapping into any access aisle. Not withstanding the provisions of title LXII or any other provision of   law, a person who violates the provisions of this subparagraph shall be fined a minimum of $50.00 for a first   offense, and a minimum of $100.00 for subsequent offense.

2) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passenger’s:

A) In front of a public or private driveway;
B) Within 15 feet of a fire hydrant;
C) Within 20 feet of a crosswalk at an intersection;
D) Within 30 feet upon approach to any flashing signal, stop sign, or traffic control signal located at the side of a   roadway;
E) Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to   any fire station within 75 feet of said entrance when properly sign-posted;
F) At any place where official signs prohibit standing.

3) Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers:

A) Within 50 feet or the nearest rail of a railroad crossing;
B) At any place where official signs prohibit;

Section 8: Any person who shall violate or permit any person to violate any of the provisions of this ordinance shall be fined according to the table listed in Section 9. If the fine has not been paid within 10 days after it has been issued, the registered vehicle owner will be notified of the violation by mail, a complaint will be issued to the registered owner of the vehicle to appear in Dover District Court where the fine shall not exceed more than $500.00.

Section 9:

Violation of any ordinance: $10.00
Parking fine paid after 10 days from ticket issuance, but before summons issue: $20.00
Parking fine paid after summons issue, but before court appearance: $30.00
Handicapped Parking: $250.00
Parking fine paid after 10 days from handicapped ticket issuance, but before summons issuance: $250.00
Parking fine paid after summons issue, but before court appearance: $250.00

For the purpose of this ordinance, proof of the identity of the registered owner of the vehicle in question shall be prima facie evidence that the registered owner parked the vehicle.

Section 9A:

Any person who fails to answer to any parking violation after a notice has been sent to the registered owner or who fails to appear in Dover District Court, or the District Court as directed, shall not be allowed to register a vehicle within the town until any and all outstanding parking violation(s) have been paid to the satisfaction of the Town Clerk of the Town of Rollinsford.

Any vehicle which has three outstanding parking violations against it, shall be towed if found parked on a way or town owned property. Said towing fee shall be the sole responsibility of the registered owner.

Said vehicle shall not be released to the registered owner until all outstanding parking violations have been paid to the satisfaction of the Town Clerk of the Town of Rollinsford.
